How do I add a Power of Attorney to my TD Direct Investing account?
First you will need to determine the type of Power of Attorney that you are looking to add:
1) A General Power of Attorney (GPA) is a legal document which gives another person legal authority to make decisions about finances and property on your behalf. A GPA can either be Continuing or Non-Continuing depending on the power granted in the legal document. Depending on the level of authority granted in the document it may authorize an attorney to do anything that the grantor could do under law (except make a will or designate beneficiaries).
Your request will be assessed in context of the conditions and restrictions noted within your GPA document.
To add a GPA: Visit your nearest TD Canada Trust branch or TD Direct Investing location to submit a copy of your GPA documentation executed in the jurisdiction of your residency. Your attorney will also need to visit to provide their ID and to sign an information form:
• The GPA document complies with the laws of the account holder's jurisdiction;
• The GPA document has been properly signed & witnessed;
• The GPA in full force and effect;
• The GPA survives / does not survive the incapacity of the donor
A US Resident cannot be added as a GPA on any Canadian domiciled accounts. A US Resident can be added as a GPA on US domiciled accounts on an exception basis provided the agent is:
(1) an immediate family member of the account holder,
(2) acting in a non-professional capacity, and
(3) residing in a ‘yes’ state. If the Power of Attorney has a US address, the POA is required to provide his/her certification of US/Non-US tax status by completing a US tax form.
Please note: The Power of Attorney is called ‘continuing’ because it continues to be valid and used after the donor is no longer mentally capable of making financial decisions themselves.
2) TD Waterhouse Inc. has a pre-formatted Power of Attorney form. This form limits a Power of Attorney's (PA) authority to deal solely with the account(s) specified on the form. The authority granted within the document will continue to be in effect even if the donor or account holder becomes incapable if the form so states.
To add a PA: Visit your nearest TD Canada Trust branch or TD Direct Investing location and complete our Power of Attorney form # 596056 E/ 596057F. Your attorney will also need to visit to provide their ID and sign the Power of Attorney form.
Please note: Witnessing requirements vary by province.
To remove a previously appointed GPA or PA from your personal TD Direct Investing account, visit your nearest TD Canada Trust branch or TD Direct Investing location and provide a signed, dated and witnessed letter of direction (detailing your request to remove the named individual). Ensure you include all impacted account numbers.
